Terms of Service

Who this agreement is with

The Design Studio at landscapecentre.studio is offered by Landscape Centre and is built and operated for Landscape Centre by StoneSwap.ai, a company based in Ontario, Canada. In these terms “we” and “us” mean Landscape Centre and StoneSwap.ai together, and “you” means the person using the Studio. Both companies may rely on these terms.

Who may use the Studio

You must be old enough to enter into a contract where you live, and you must use the Studio for a real property project — your own, or one you are working on for a client. One account per person. The details you give us must be accurate and kept up to date.

The Studio is offered in the regions Landscape Centre chooses to serve, and access from outside them may be refused. To apply that, the Studio needs to establish where you are, which is why it asks for your postal code and, once, for your browser’s location permission. If it cannot establish that, it may decline to produce a design.

What the Studio does — and does not do

You upload a photograph of a property, choose products, and an automated system produces a picture of what that property could look like with those products on it.

In the words shown on every result, share page and proposal sheet: AI-generated concept for inspiration only. Product appearance, colors and layout in this visualization are not guaranteed and may differ significantly from the actual products.

To be completely clear about what a render is not:

Confirm everything with Landscape Centre, an authorised dealer or a qualified installer before you buy materials or start work. Neither Landscape Centre nor StoneSwap.ai is your contractor, and producing a render does not create a relationship between you and any dealer.

Your photos and your designs

You keep ownership of every photograph you upload. You must have the right to upload it: it should be your property, or a property you have permission to photograph and to submit. Do not upload pictures of people who have not agreed to it, and do not upload anything unlawful, infringing, hateful, sexual or designed to deceive.

So that we can actually run the Studio, you give us permission to store your photograph, send it to our AI provider, produce images from it, keep those images for the retention period, and show them to you, to Landscape Centre and to anyone you choose to share them with. That permission lasts only as long as we hold the material and exists only for those purposes. Details of who receives what are in the Privacy Policy.

Designs and the photographs behind them are deleted automatically 365 days after they are created, and you can delete your account and its content at any time from Settings → Account. Download anything you want to keep.

Who may use the generated image

You may use the images the Studio makes for you freely for your own project: to plan it, to show family, to send to a contractor, or — if you are a contractor — to present to your client. You may not present a render as an approved plan, an official Landscape Centre product photograph, or a quotation.

Landscape Centre and StoneSwap.ai may use your designs to operate, secure and improve the Studio and, in Landscape Centre’s case, to understand its own customers. We will not publish your image publicly or use it in advertising without asking you first.

A share link you create is a public web address: anyone who has it can open the design without signing in. It does not show your name or contact details, and it stops working when the design is deleted.

Renders, credits and payment

Each design you generate costs one render credit.

Safety checks, suspension and termination

Uploads, prompts and account behaviour are screened automatically. A check may refuse an individual design, and repeated or serious breaches may lead to an account being suspended or removed. Where an account is suspended, free credits are forfeited; where an account is removed altogether, any remaining balance goes with it, exactly as it would if you deleted the account yourself. If you think a decision was wrong, write to [email protected] and a person will review it.

You may stop using the Studio at any time and delete your account from Settings → Account. We may also stop offering the Studio, or change what it does, at any time.

Intellectual property

The Studio software, its interface and everything StoneSwap.ai has built into it belong to StoneSwap.ai. The Landscape Centre name, logos, product names, product photography and catalogue data belong to Landscape Centre. Nothing in these terms gives you a licence to use either company’s trade marks or branding. Your photographs and the designs made from them are covered in the two sections above.

No warranty

The Studio is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind about it — including that it will be uninterrupted or error-free, that a render will be accurate or suitable for any purpose, or that a product shown will be available. Some jurisdictions do not allow certain warranties to be excluded, and nothing here removes a warranty or guarantee that the law does not let us remove.

Limitation of liability

To the fullest extent the law allows, neither Landscape Centre nor StoneSwap.ai is liable for indirect, incidental, special or consequential losses, or for lost profits, lost data, or the cost of work carried out or materials bought in reliance on a render. Our total liability for any claim connected with the Studio is limited to the greater of the amount you paid us for credits in the twelve months before the claim, or CAD $100.

This section does not limit liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited under the law that applies to you — including mandatory consumer protection legislation such as Quebec’s Consumer Protection Act.

You are responsible for what you upload, and you agree to cover us against third-party claims arising from content you had no right to submit.

Governing law

These terms are governed by the laws of the Province of Ontario, Canada, and the courts there have jurisdiction. If you are a consumer, this does not take away your right to bring a claim in the courts of the province, territory or state where you live, or to the protection of the mandatory consumer laws there.

Changes to these terms

We may update these terms. When we do, the “last updated” date at the top changes; if the change is significant we will tell you. Continuing to use the Studio after an update means you accept the revised terms. If you do not accept them, delete your account.

These terms are written to be read and understood rather than to be exhaustive. They describe how the Landscape Centre Design Studio works today; they do not limit any right you have under applicable consumer law, and they are not legal advice.
